    Ombudsman’s recommendation: If removal is delayed that DIAC again consider alternative forms of detention—with community support as needed.

    Peruvian citizen aged 47 in detention for two years and four months; anxiety, depression with psychotic features and PTSD symptoms. Review/Courts: MRT/RRT/FMC.
    Ombudsman’s recommendation: That DIAC arrange an assessment, of Mr X’s competence to make decisions about his immigration matters, his fitness to travel, and the appropriateness of continued detention. That the Minister consider appropriate living arrangements while Mr X’s immigration matters remain unresolved.

    Ombudsman’s recommendation: Release from immigration detention under s 253(9), request for an explanation if not released.

    New Zealand citizen aged 39 in detention for two years; personality disorder; allegedly assaulted other detainees, knee injuries in detention. Visa cancelled under s 109. For removal. Review/Courts: MRT/FMC/FFC.
    Ombudsman’s recommendation: That DIAC does all that is reasonable to keep Mr X advised of progress of claim for loss of property in Baxter fire and expedites fair compensation.

    Ombudsman’s recommendation: That DIAC confirm Mr X’s preferred destination for removal. That a decision be made on the s 417/48B request as soon as possible. If there are further delays in removal that DIAC consider alternative detention.

    Ombudsman’s recommendation: That Mr X be placed in community detention with appropriate psychiatric care and support until his immigration outcome is more certain. That close and regular monitoring of the impact of removal plans upon Mr X’s mental health be maintained.

    Ombudsman’s recommendation: That DIAC reviews his suitability for alternative detention in the community.

    Ombudsman’s recommendation: That a suitable visa with work rights be granted.

    Ombudsman’s recommendation: Prior to removal DIAC offers reasonable compensation for transfer. That fitness to travel addresses the impact of removal on his mental health and strategies to ensure his safety.

    Combined third and fourth report, previous report # 143/07. Turkish citizen aged 31 in detention for three and a half years; Major Depression and psychiatric hospitalisation. PV application – ongoing.
    Ombudsman’s recommendation: That a suitable visa with work rights be considered while Mr X’s immigration status is resolved. If released into the community, DIAC to consider psychiatric and medical support.

    Ombudsman’s recommendation: To grant Mr X a suitable visa, or implement alternative detention, if not removed by late February 2008.

    Ombudsman’s recommendation: No recommendation. Noted difficulties associated with safety and security of detainees and staff when detaining a person long-term who is suffering from a mental illness.

    Ombudsman’s recommendation: That Mr X be granted a suitable visa with work rights or that an alternative detention arrangement be implemented.
