    Ombudsman’s recommendation: that the Minister grant Mr X Community Detention or a suitable visa while his immigration status is resolved.

    2nd report, previous report 506/09. New Zealand citizen residing lawfully in the community on RPBV. Case to be referred to Minister in two years for consideration of PV.
    Ombudsman’s recommendation: in light of Mr X’s age and low risk factor, the Ombudsman suggests that the Minister consider shortening the period in which Mr X will be considered for a permanent visa.

    2nd report, previous report 509/09. New Zealand citizen in detention since October 2007; SASH, history of substance abuse, methadone program, s 501 visa cancellation, Australian citizen partner; request to transfer to SIRH denied due to criminal history; no incidents for past six months. Review/Courts: FC/FFC.
    Ombudsman’s recommendation: that Ms X be reconsidered for transfer to SIRH while her immigration status is resolved.

    7th report, previous reports, and 484/08, 426/08, 360/08. PRC citizen. Transferred to Community Detention in December 2008. Some psychological and physical concerns remain and treatment continues in the community. Review/Courts: RRT/IMR from UNHRC.

    2nd report, previous report 535/09. Claims to be citizen of Italy but cannot be verified. The Minister is considering placing Mr X in a community detention arrangement until his identity can be confirmed.

    Vietnamese citizen aged 34 in detention since April 2007; Australian citizen partner; reformed addict; management issues in 2007; s 501 visa cancellation. Review/Courts: AAT/FC/RRT/FFC.
    Ombudsman’s recommendation: if resolution of Mr X’s immigration status is a long term matter, that the Minister place Mr X in Community Detention so that he can live with his partner and family or grant him an appropriate visa while his immigration matters are resolved.

    2nd report, previous report 533/09. U.K. citizen. DIAC acknowledges unreasonable delay in assessing Community Detention submission; Minister declined to intervene in Mr X’s case. Mr X escaped from detention on an external escorted medical appointment in May 2009.

    5th report; previous reports 512/09, 417/08, 238/07. PRC citizen. Correction provided to previous report. Further psychiatric review undertaken in regard to mental health issues. Mr X removed to the PRC July 2009.

    Review/Courts: nil.
    Ombudsman’s recommendation: that the Minister review whether the continued detention of Mr X is consistent with the Immigration Detention Values and if it is consistent with these values then consideration should be given to an alternative detention arrangement that will provide a less restrictive environment.
