    PNG citizen aged 35 detained two years and two months; parents and siblings live in Australia and are either permanent residents or citizens; s 501 visa cancellation. Review/Courts: FMC/FC/RRT.

  • Immigration report 571/09 (1.02MB)

    Albanian siblings aged 17, 15 and 9 years old. Following mother’s disappearance, in Community Detention for almost two and a half years; DIAC attempted to reunite children with their purported father in Albania. Children refused to communicate with him or acknowledge him as their father. Complicated by uncertainty over guardianship. Granted Vulnerable Child visas.
    Ombudsman recommendation: that DIAC review its policy instructions in the case of abandoned minors and ensure that DIAC staff are better equipped to deal with these cases of conflicting duties when they arise.

    New Zealand citizen aged 35 in detention two years and three months; arrived in Australia aged 10; s 501 visa cancellation. Review/Courts: AAT/FC/FFC (ongoing). Minister’s review: for removal.
    Ombudsman recommendation: that Mr X be considered for Community Detention with appropriate reporting and support arrangements as it is unlikely he will be removed in the near future.

    Ombudsman recommendation: if travel document is delayed, that the Minister allow Mr X to live in a community detention arrangement or be granted an appropriate visa until he is able to be removed.
